This paper has as its scope the use of the vote from the Reporting Minister, Celso de Mello, on the criminalization of trans and homophobia, in ADO nº 26, in a judgment that took place in 2019, at the Federal Supreme Court - STF. We decided to carry out an analysis that highlights the existing connection between Law and Rhetoric in one of the points of convergence: the discourse. Therefore, the objective of the research is to analyze the discourse in the vote of the Minister of the Federal Supreme Court - STF, Celso de Mello the discourse of criminalization of homo(trans)fobia in the perspective of how, through argumentation, the author constructs reality about the thesis defend . As specific objectives, we propose: a) to identify the main arguments based on the structure of reality on questions related to homo(trans)phobia; b) search in the discourse data of reality that prove the arguments that support the thesis; c) correlate arguments and data from reality, to values and hierarchies for the construction of meaning for the thesis in defense of the criminalization of homo(trans)phobia. All research is focused on studies of the New Rhetoric. Thus, the fundamentals are mainly based on the argumentation theory of Perelman and Lucie Olbrechts-Tyteca (2005), in addition to the contribution of Reboul (2000) and Abreu (2009). This work is the result of a documental research, with analysis and interpretation of a corpus constituted by a document, therefore, the very value of the vote is documentary. The preliminary results, we identified the suitability of the argumentative techniques to the minister's arguments, specifically based on reality, in addition to verifying the dignity of the human person at the top of the hierarchy of values, leaving the equality of human beings in the background.
